Stages of Criminal Proceedings

If a person is accused of committing a crime in Ontario, they will go through a series of steps in the criminal justice system. Below are the general stages of a criminal proceeding in Ontario:

  1. Arrest: Upon being arrested you will either be released by the police or held for a bail hearing. If released on an undertaking, you will be provided conditions you must follow along with the date of your court appearance.
  2. Bail Hearing: Typically, within 24 hours of an arrest, an accused person will have a bail hearing. During the hearing, a justice will determine whether the accused will be released or remain in custody for the remainder of the case. An Assault lawyer will help you create a viable release plan.
  3. Disclosure: All the evidence held by the Crown related to the case will be provided to the defence lawyer. Typically, this is provided closer to the first date and shared with the lawyer digitally.

  7. Decision/Sentencing: After the trial is complete, the judge or jury will reach a decision on whether the accused is guilty or not guilty. If the accused is found guilty, they will be sentenced. The sentence will vary depending on each matter and the severity of the crime.
